These Terms of Service ("Terms") govern your access to and use of Radial — our iOS app, our website, and any related services (collectively, the "Services"). By creating an account, joining the waitlist, or otherwise using the Services, you agree to these Terms. Please read them carefully.

1. acceptance of terms.
By creating an account, joining a waitlist, downloading or installing the app, or otherwise accessing the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
These Terms form a binding contract between you and Radial. If you are accessing the Services on behalf of another person or entity, you represent that you have authority to bind them, and "you" refers to them as well.
2. eligibility.
You must be at least 18 years old to use Radial. By using the Services, you represent and warrant that:
- You are 18 or older.
- You have the legal capacity to enter into a binding contract.
- You are not barred from using the Services under the laws of the United States or any other applicable jurisdiction.
- You have not previously been removed from Radial for violating these Terms.
- You are not a registered sex offender or required to register as one in any jurisdiction.
We may refuse service, close accounts, or change eligibility requirements at any time, in our reasonable discretion.
3. your account.
3.1 creating an account.
To use most features of Radial, you'll need to create an account by verifying your phone number. You agree to provide accurate information about yourself, including your real first name, current photos that clearly depict you, and your true age. Pretending to be someone else or misrepresenting yourself is a violation of these Terms.
3.2 one account per person.
You may only maintain one Radial account. We may take steps to detect and remove duplicate accounts.
3.3 keeping your account secure.
You are responsible for the activity that happens under your account and for keeping the device on which you're signed in secure. Tell us immediately if you suspect unauthorized access by emailing security@joinradial.com.
4. license to use radial.
Subject to your compliance with these Terms, Radial grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, and use the Services on devices you own or control, solely for your own personal, non-commercial use.
You agree not to:
- Copy, modify, distribute, sell, lease, or sublicense any part of the Services.
- Reverse engineer, decompile, or disassemble the Services, except where applicable law expressly permits it.
- Access the Services through automated means (bots, scrapers, crawlers) or attempt to interfere with our infrastructure, security, or rate limiting.
- Use the Services to build a competing product or to train, fine-tune, or evaluate machine-learning models.
- Remove or obscure any proprietary notices or branding.
5. user content.
5.1 what you post is yours.
Photos, profile information, notes, and other materials you submit through the Services ("User Content") remain yours. We don't claim ownership of your content.
5.2 license to radial.
To run the Services, we need your permission to use your User Content. You grant Radial a worldwide, non-exclusive, royalty-free, sub-licensable, transferable license to host, store, reproduce, modify (for example, to resize a photo), publish, transmit, and display your User Content, solely for the purpose of operating, providing, improving, and promoting the Services. This license ends when you delete the User Content or your account, except (a) where you've already shared content with another user (who may have retained a copy consistent with our Privacy Policy), and (b) for the limited time needed for backup rotation and legal recordkeeping.
5.3 your representations.
You represent and warrant that:
- You own or have all necessary rights to your User Content.
- Your User Content is accurate and not misleading.
- Photos clearly depict you, are recent, and aren't manipulated to misrepresent your appearance, age, or identity.
- Your User Content does not violate any law or any third party's rights (privacy, publicity, intellectual property, etc.).
5.4 our right to remove.
We may remove or restrict access to any User Content that we believe violates these Terms or the law, or that we deem otherwise harmful or objectionable, in our reasonable discretion and without obligation to do so. We are not a publisher of User Content and do not endorse it.
6. acceptable use and prohibited conduct.
Radial is meant to feel safe, intimate, and human. The following are not permitted on the Services. This list is not exhaustive — use good judgment.
- Harassment, hate, or abuse — including stalking, threats, slurs, or content that targets people based on protected characteristics.
- Sexual content involving minors — zero tolerance. We report suspected child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC) and law enforcement.
- Nudity, pornography, or solicitation — Radial is not a platform for explicit content or sex work.
- Violence, weapons, or dangerous goods — promoting, selling, or coordinating any of the above.
- Drugs and other controlled substances — facilitating sale or distribution.
- Impersonation, fake profiles, or catfishing.
- Scams, fraud, or commercial solicitation — including phishing, "pig butchering," advance-fee schemes, or directing users to external monetization.
- Spam — unsolicited promotional content of any kind.
- Doxxing or sharing private information about other users without consent.
- Recording or screenshotting other users' content for distribution outside Radial.
- Circumventing safety or moderation systems — including evading bans, abusing reporting tools, or using location-spoofing tools.
- Anything illegal under applicable law.
We may report illegal activity to law enforcement, and we may preserve and disclose information as required or permitted by law.
7. safety in real-world meetings.
Radial is designed to lead to in-person interactions. You are responsible for your own safety. Always meet in public, tell someone you trust where you'll be, and trust your instincts. We do not conduct background checks on users beyond the safety steps disclosed in our Privacy Policy. The fact that someone has a Radial account does not mean they are who they say they are or that they are safe to interact with. If you ever feel unsafe, leave, contact local emergency services if needed, and report the user in the app.
8. privacy.
Our Privacy Policy describes how we collect, use, and share your information. By using the Services, you agree to the practices described there.
9. third-party services and app stores.
9.1 third-party services.
The Services may include links to or integrations with third-party services we don't control (e.g. external maps, share sheets). We are not responsible for those services and your use of them is governed by their own terms.
9.2 apple app store.
If you download Radial from the Apple App Store, the following also applies, and these Terms are between you and Radial — not Apple:
- Apple is not responsible for the Services or for addressing any claims relating to them (including product liability, legal compliance, or consumer protection claims).
- In the event of any failure of the iOS app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligations with respect to the app.
- You and Radial acknowledge that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you.
- You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.
- You agree to comply with all applicable third-party terms (e.g. your wireless carrier's data plan terms) when using the iOS app.
10. fees, subscriptions, and refunds.
Radial is currently free to use. We may introduce paid features in the future. If we do, we'll display the price and terms before you're charged, and any subscriptions will be billed through the Apple App Store under Apple's billing terms. Refunds for App Store purchases are handled by Apple under its policies.
11. intellectual property.
The Services — including the Radial name, logo, brand, software, designs, copy, and underlying technology — are owned by Radial and protected by intellectual property laws. Except for the limited license in section 4, no rights are granted to you in the Services.
12. feedback.
If you send us suggestions, ideas, or feedback, you grant Radial a perpetual, irrevocable, worldwide, royalty-free license to use that feedback for any purpose, without obligation to you. We're grateful for it — but we can't keep your feedback confidential or compensate you for it.
13. copyright complaints (dmca).
If you believe content on Radial infringes your copyright, send a notice to dmca@joinradial.com including: (a) your physical or electronic signature; (b) identification of the work claimed to be infringed; (c) identification of the material claimed to be infringing and information sufficient for us to locate it; (d) your contact information; (e) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (f) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or are authorized to act on the owner's behalf. We will respond to valid notices and may terminate the accounts of repeat infringers.
14. suspension and termination.
We may suspend or terminate your access to the Services, at any time and without notice, if we reasonably believe you have violated these Terms, created risk or possible legal exposure for Radial or others, or if we are required to do so by law. We may also discontinue all or part of the Services at any time. You may stop using the Services and delete your account at any time through Settings → Account, or by emailing privacy@joinradial.com. Sections that by their nature should survive termination — including sections on User Content licenses, IP, disclaimers, liability, indemnity, and disputes — will survive.
15. disclaimers.
The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by law, Radial disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Services will be uninterrupted, secure, error-free, or that any content (including User Content) will be accurate or reliable.
Radial is not responsible for the conduct of any user, on or off the Services. We do not perform criminal background checks. We make no representation about the suitability of any user. Any decision to interact with another user is your own.
16. limitation of liability.
To the fullest extent permitted by law, in no event will Radial, its affiliates, officers, directors, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, goodwill, or business opportunities, arising out of or related to your use of the Services, whether based on warranty, contract, tort (including negligence), product liability, or any other legal theory, and whether or not we have been informed of the possibility of such damages.
To the fullest extent permitted by law, Radial's total cumulative liability arising out of or related to these Terms or the Services will not exceed the greater of (a) the amount you paid Radial in the twelve months preceding the event giving rise to the liability, or (b) US$100. Some jurisdictions don't allow certain limitations, so some of the limitations above may not apply to you.
17. indemnification.
You agree to defend, indemnify, and hold harmless Radial and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any law or third-party right.
18. governing law and dispute resolution.
18.1 governing law.
These Terms and any dispute arising from them are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles, except that the Federal Arbitration Act governs the arbitration provisions below. Where applicable, this choice of law does not deprive you of the protection afforded by mandatory consumer-protection laws of your country of residence.
18.2 informal resolution.
Before filing any formal claim, you agree to try to resolve the dispute informally by emailing legal@joinradial.com with a description of the issue. We'll attempt to resolve it within 60 days.
18.3 binding arbitration; class waiver.
If we can't resolve a dispute informally, you and Radial agree to resolve any claim arising out of or relating to these Terms or the Services through final and binding arbitration, on an individual basis. You and Radial waive the right to a trial by jury and the right to participate in a class action. Arbitration will be conducted by JAMS under its rules then in effect, in English, and in a location reasonably convenient to you. Either party may bring an individual claim in small-claims court instead.
18.4 opt-out of arbitration.
You may opt out of the arbitration agreement in section 18.3 by emailing legal@joinradial.com within 30 days of first accepting these Terms, with the subject line "Arbitration Opt-Out" and your account information. Opting out won't affect any other part of these Terms.
18.5 exceptions.
Either party may bring a lawsuit in court solely for injunctive or equitable relief related to intellectual property infringement or misuse of the Services.
19. changes to the services or these terms.
We're actively building Radial and will change features over time. We may add, change, suspend, or discontinue features at any time. If we make material changes to these Terms, we'll update the "last updated" date and give reasonable notice (for example, by email or in-app). If you continue to use the Services after the change takes effect, you accept the updated Terms. If you don't, you can stop using the Services and delete your account.
20. general.
- Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and Radial regarding the Services.
- Severability. If any provision is held invalid, the rest remain in effect.
- No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms without our written consent. We may assign these Terms to an affiliate or in connection with a corporate transaction.
- Third-party beneficiaries. Except as stated in section 9.2 (Apple), there are no third-party beneficiaries to these Terms.
- Notices. We may give notice via email, in-app messaging, or by posting on our site.
- Force majeure. We're not liable for delays or failures caused by events beyond our reasonable control.
